Professional Negligence or Professional Malpractice

What is professional negligence and how does it affect you as a claimant/client?

Solicitors, barristers, and insurance companies sometimes rush their client’s claims and occasionally ask their candidates to settle for a smaller settlement than what the insurance companies offer. This is usually to settle the claim quickly and move forward to the next client increasing their profit. However, this leaves you with poor compensation barely covering the injuries you may have faced and no support for any psychological impact you have suffered. This type of service is not providing the standard requirements a solicitor or claims company is required to legally follow, and therefore comes under professional negligence.

For example, if you have been a victim of a non-fault road traffic accident and the insurance company offers you £8000 for your vehicle damages and personal injuries, and the claims management company has asked you or persuaded you to settle for a smaller sum of the offered payment. This could be to settle the claim promptly without any extra work or issues that they would have to deal with. This can affect the client drastically moving forward, as not all solicitors or claims management companies work on a No Win No Fee basis like us, therefore there would be a great financial impact on the client.

You should never settle for less than what you are offered.
